Law Enforcement & Government Request Policy
1. Our Commitment
We treat your data, especially your reproductive and mental-health information, as highly sensitive. We disclose user data to law enforcement or government authorities only when legally required and after careful review, and we work to protect users from overbroad or improper requests.
2. We Require Valid Legal Process
We do not voluntarily disclose user data to authorities except in the emergency circumstances below. We require a legally valid, properly served process, and we assess the type of process against the data sought:
- Basic subscriber information may require a subpoena or equivalent.
- Stored content and sensitive data (such as conversations and health information) require a search warrant or equivalent court order based on probable cause, where applicable law so provides.
We review each request for legal validity, jurisdiction, and scope, and we object to or seek to narrow requests that are overbroad, vague, or improper.
3. Reproductive Health Data
We will scrutinize with particular care any request seeking reproductive-health information. Where we have a lawful basis to do so, we will object to, narrow, or challenge requests that appear directed at investigating or penalizing individuals for seeking, providing, or supporting lawful reproductive health care. We will comply only with legally valid and enforceable process.
4. Notice to Users
Where legally permitted, we will notify affected users before disclosing their data, so they have an opportunity to object, unless we are prohibited from doing so (for example, by a court-ordered gag) or unless there is an emergency involving risk to life.
5. Emergency Requests
In good faith, we may disclose limited data without legal process where we reasonably believe it is necessary to prevent imminent death or serious physical harm to a person. We disclose only the information reasonably necessary to address the emergency.
6. Minimization
We disclose only the specific data responsive to a valid legal request, and nothing more. Because we apply strict data-minimization practices (for example, we limit the retention of user-uploaded media to active account lifecycles and enforce brief retention periods with our AI providers), there may be responsive data that we simply do not possess or have already permanently erased.
7. Transparency
Requests should be directed to legal@ninthmoon.ai. We may publish aggregate information about the requests we receive. Nothing in this policy waives any legal right or remedy available to NinthMoon or its users.
